What is a Seafarer's Employment Agreement (SEA)?
In the Merchant Navy, a contract is officially called the Seafarer's Employment Agreement, or simply the SEA. It is a legally binding document signed between the seafarer and the vessel owner (through a recruitment and placement agent called an RPSL).
Before you step foot on a ship, this agreement defines your rank, salary, contract period, duties, rights, and protections. In India, these contracts must comply with both the Maritime Labour Convention (MLC 2006) and the Merchant Shipping Act.
Important: A seafarer must be given sufficient time to read, understand, and ask questions about the SEA before signing. The TOE (Terms of Employment) document that comes with it has equal legal standing.

Section 02
Key Parties in a Merchant Navy Contract
Understanding who signs the contract and who is responsible for what is crucial — especially when disputes arise.

You — the employee. You sign and are legally bound by the SEA and TOE.

Salary Structure — What You Actually Earn
A Merchant Navy salary has multiple components. Your total take-home is not just "basic wages." Here is a sample Chief Officer salary breakdown to understand the structure:

Other Earnings (One-Time & Monthly)
- Joining Allowance (One-Time): USD 50 for officers, USD 30 for ratings — paid at joining.
- Long Service / Loyalty Bonus: USD 60–240/month for senior officers after 9+ months of total sea service.
- Superior Certificate Allowance: Extra pay if you hold a higher certificate than required (e.g., Master COC on a Chief Officer berth).
- Rejoining Bonus: Paid when re-joining after a successful previous contract.
- High Risk Area (HRA) Bonus: Extra pay as per CBA when the ship transits a designated high-risk area (Gulf of Aden, etc.).
Deductions
- JSU Retirement Deduction: ~USD 80/month — goes to your retirement fund.
- Cash advances taken onboard are deducted from monthly wages.
- Provident Fund contribution (where applicable under CBA).
Wage Calculation Rule: Every month is counted as 30 days. Part-month wages = (Days onboard × Gross Monthly Wages) ÷ 30.

Contract Period & Rank-wise Duration
The duration of a Merchant Navy contract varies by rank. The maximum any seafarer can be kept onboard is 11 months. Typical durations are:

Chief Engineer / 2nd Engineer

(3/O, 2/E, ETO, etc.)

The employer also has a 30-day relief window (±30 days from the contract expiry date), meaning you may be relieved slightly before or after your exact end date depending on port availability, flight connections, and relief availability.
Extension of Contract
Extensions are not encouraged due to fatigue and complacency risks. If you wish to extend, you must submit a written application through the Master at least 30 days in advance. The employer's decision is final.

Your Rights Under the Contract
As a seafarer, you are entitled to a wide range of rights — many of which are guaranteed by the MLC 2006 and cannot be waived:

Employer provides free medical treatment for illness or injury while onboard.

MLC 2006 — The International Law Behind Your Contract
The Maritime Labour Convention (MLC) 2006 is the "seafarers' bill of rights" — a treaty adopted by the International Labour Organization (ILO) that sets global minimum standards for working and living conditions on ships.
Key MLC Protections for Your Contract
- No seafarer below 18 years of age can be employed onboard.
- Contract duration must not exceed 11 months continuously.
- A financial security system must be in place to protect crew from ship abandonment.
- If a ship is arrested for 30+ days, the seafarer may terminate the contract.
- If held captive due to piracy, wages continue until repatriation or confirmed death — contract remains valid even past expiry.
- Sick wages are payable as per CBA after P&I Club approval.
- Death and disability compensation must be provided.
CBA vs SEA: Your contract must be read alongside the applicable Collective Bargaining Agreement (CBA) — in this case the IBF JSU NUSI MUI-IMMAJ CA. In any conflict between the SEA and the CBA, the CBA terms prevail.
Section 07
Contract Termination & Early Relief
Normal Termination
- Contract expiry date as stated in SEA is reached.
- Seafarer signs off due to illness/injury (medical grounds).
- Sale or total loss of the vessel.
Employer May Terminate If:
- One month's written notice is given.
- Seafarer is in serious default of duties (after formal inquiry).
- Ship is laid up for more than 1 month or changes flag/registry.
Seafarer May Terminate If:
- One month's notice given for justified reasons.
- Spouse, parent, or dependent child has dangerously ill or died (compassionate grounds).
- Ship is about to sail into a war zone or IBF-designated High Risk Area.
- Ship is certified substandard under SOLAS/MARPOL/STCW.
Early Relief Warning: If you resign or leave before contract completion without valid grounds, you must pay for your own repatriation and all associated travel costs. This can be significant.
Probation Period
First engagement carries a 45-day probation period. First 3 months after promotion to a new rank are also probationary. During probation, either party can terminate without the premature termination penalty — but repatriation costs are borne by the party that terminates.

Is a Merchant Navy contract the same as a job offer letter?
No. A job offer letter is just an informal communication. The SEA (Seafarer's Employment Agreement) is the actual legal contract — it is signed digitally, witnessed, and governed by MLC 2006 and Indian maritime law. It is the only document that legally binds both the seafarer and the employer.
When does my salary start in Merchant Navy?
Your basic wages start from the day you depart your place of engagement (e.g., Ranchi or your home airport) — not from when you board the ship. Full wages apply from the time you sign on to the vessel until you sign off.
Can a company change my salary during the contract?
Only upward revisions can be made — if the CBA wage structure is revised and the new rate exceeds your current gross wages, your wages will be increased accordingly. Employers cannot reduce your wages during an active contract.
What is the difference between basic wages and gross wages?
Basic wages are the CBA-minimum component. Gross wages include basic wages plus all allowances (employer special allowance, overtime, leave pay, subsistence, etc.). Net wages are gross wages minus deductions like JSU retirement and cash advances.
What happens if I get sick onboard a ship?
The employer must provide free medical care. If you sign off on medical grounds, you are entitled to sick wages as per the CBA for the period mentioned, or until a company-designated doctor declares you fit — whichever comes first. P&I Club insurance covers serious cases.
Can I take my family on a Merchant Navy ship?
Officers can take their spouse and children onboard, subject to employer and Master approval, available accommodation, and LSA capacity. Master and Chief Engineer can carry family for the full contract; all other officers are limited to 3 months. Children must be 12–16 months old (minimum) depending on the trade.
How is leave calculated in Merchant Navy?
Leave accrual is typically 20 days per month for officers and 11 days per month for ratings/trainees. After your contract ends and you sign off, this leave accrual is used to calculate your next availability date through the company's app (e.g., Synergy's "Ahoy" app).
What documents should I carry for contract joining?
Passport (with at least 3 blank pages), CDC (Continuous Discharge Certificate), COC (Certificate of Competency), STCW certificates, medical fitness certificate, flag state endorsement, SID/DCE, and the signed employment contract. All documents must be valid for 6 months beyond your contract tenure.
